Introduction:
- The term "Event(s)" refers to leisure activities promoted by Parque do Caracol or organized by its Partners, including but not limited to access to the Park, music concerts, sports events, festivals, exhibitions, or any other cultural and entertainment content that requires an access pass for entry.
- The term "Ticket(s)" refers to the right of access to Parque do Caracol, as well as to Event(s) or Service(s) organized by Parque do Caracol or its Partners. This access may be granted through a physical ticket, digital format, or other methods containing a validation mechanism such as a barcode, biometrics, or QR code, issued exclusively by Parque do Caracol and sold or distributed through our digital platform or physical ticket offices. Event(s) or Service(s) organized by Partners may have their Tickets sold separately from those granting access to Parque do Caracol.
- The term "User(s)" refers to any individual who (i) provides their information on Parque do Caracol's platform, after reviewing and agreeing to the Terms of Use, in order to use any available tools; (ii) purchases a Ticket, product, or service through any available sales channel, including the Official Ticket Office (physical sales); or (iii) is a visitor in general.
- The term "Package(s)" refers to any bundled offers that may be made available for the sale of a Ticket along with one or more additional products or services.
- The terms "Product(s)", "Service(s)" and "Experience(s)" refer to the products/services/experiences offered for sale through the physical or online platforms of Parque do Caracol.
- The term "Voucher(s)" refers to purchase confirmations for products, services, or experiences.
- The term "Partner(s)" refers to companies that work in collaboration with Parque do Caracol to promote and organize Event(s) or to resell Ticket(s).
- This "Purchase Policy" sets forth the terms and conditions applicable to Ticket purchases.
1. Legal Binding Agreement:
1. In this Purchase Policy, we refer to any products and applicable services offered for sale by us.
1.1. To purchase a Ticket—whether through the Ticket Office or our online platform—the User must be at least 18 (eighteen) years old and capable of entering legally binding contracts. If the User is making an online purchase, they must provide the required information on the Parque do Caracol website and agree to its Terms of Use.
1.2. Any purchase made on our platform (physical or online) constitutes a legally binding agreement that is subject to: (i) this Purchase Policy; (ii) any special terms and conditions declared applicable to a specific Item and/or Event; and (iii) other terms and conditions established by the Partner(s) of any Event(s) taking place at Parque do Caracol. Users must read this Purchase Policy carefully before making any purchase.
1.3. By purchasing one or more Items through our platform (physical or online), the User acknowledges and agrees to be bound by the terms and conditions of this Purchase Policy. If the User disagrees with this Purchase Policy or any other applicable terms and conditions, or if they are unable to comply with them, they should not proceed with a purchase.
1.4. We reserve the right to make changes to this Purchase Policy from time to time. Whenever changes are made, we will publish the updated version of this Purchase Policy on our website. Therefore, we recommend that Users check this Purchase Policy regularly to stay informed about the current terms and conditions. All purchases are subject to the version of this Purchase Policy that is in effect at the time of the purchase. If the User does not agree with any revised version of this Purchase Policy or cannot comply with it, they should not proceed with a purchase.
1.5. The ticket sales website is owned by Parque do Caracol.
1.6. The Ticket sales platform is owned by Parque do Caracol.
1.7. The rules for purchasing and canceling Tickets—whether acquired through the Parque do Caracol website or in person at the venue—are established by Parque do Caracol and governed by this Purchase Policy.
2. Prices, Payments, and Orders:
2.1. All Ticket prices sold through our official channels include applicable taxes, in accordance with current legislation.
2.2. Accepted payment methods include debit cards and cash (for in-person purchases only), credit cards, and PIX transfers.
2.3. All purchases are subject to credit or debit card verification (if applicable), as well as other security checks. Supporting documents may be requested to complete the order. Orders may be canceled if they do not pass our verification process or if full payment is not received. In rare cases, if payment is canceled by the bank or payment provider, we reserve the right to cancel and refund any order—even if a confirmation has already been issued.
2.4. We reserve the right to cancel any orders that we reasonably suspect to have been made fraudulently, without prior notice to the User. Any and all Items obtained through such orders will be voided. Please make sure to carefully read the full item description and review your selection before purchasing.
2.5. The purchase is subject to Ticket availability and approval by your credit/debit card provider or receipt of the PIX transfer, which may take up to 5 (five) days. Customers will only receive confirmation of their scheduled visit after payment has been successfully processed.
3. Delivery:
3.1. If the purchase is made through our website (Parque do Caracol) and the online delivery option for the Ticket is available, the User is responsible for (i) ensuring they log into their account and download their Tickets/Vouchers in a timely manner before the scheduled visit; or (ii) providing a valid email address for the online delivery of Tickets/Vouchers and ensuring that email delivery can be completed (for example, by making sure their inbox does not reject, bounce, or block any email), and must regularly check their inbox — including spam and junk folders.
3.2. The User will not be entitled to any refund if the Ticket/Voucher is lost, not redeemed, not received in their email inbox, or not downloaded from their account on our website (Parque do Caracol) due to their failure to provide accurate and complete delivery information and/or failure to ensure possession of the Ticket/Voucher.
3.3. The User must contact us through our Customer Service (email: [email protected]) immediately in the event of any mistake or issue with their Ticket/Voucher, or if they do not receive their Ticket/Voucher as requested and/or as described in the order confirmation.
4. User Rights and Responsibilities:
4.1. Any Ticket purchase made through our official channels (Parque do Caracol website or physical Ticket Office) grants a personal license for access to the event/location, which may be subject to cancellation under the terms of this agreement.
4.2. Upon receiving or collecting your Tickets/Vouchers, store them in a safe place. We are not responsible for any lost, stolen, misplaced, damaged, or destroyed Tickets/Vouchers after they have been received by the User. Exposure to moisture, sunlight, or heat may damage physical tickets/vouchers. Additionally, we recommend that Users do not post photos or details of their Tickets/Vouchers online, as this may allow third parties to counterfeit them or compromise their validity. We will not be held responsible if entry is denied due to such actions.
4.3. Carefully review your order details (visit date, ticket type, and quantity) before confirming your purchase. Your Ticket is a unique product—once purchased, it is no longer available for sale.
4.4. For purchases made with a third party's credit card, it is mandatory to present a copy of the official photo ID of the cardholder and a copy of the front side of the credit card used in the purchase. Failure to provide these documents may result in denied entry.
4.5. For online Ticket purchases, you may present your Ticket/Voucher in printed form (by printing it out) or in digital format (on a mobile phone or tablet, for example). These documents will contain a QR Code that will be scanned at the turnstiles.
4.6. Tickets and/or Vouchers obtained from unauthorized sources may be invalid, lost, stolen, or counterfeit; Parque do Caracol may revoke, void, or cancel such items upon detection, with no right to a refund.
4.7. Parque do Caracol will provide support only to the User—i.e., the individual or legal entity who submitted their information and completed the purchase—and exclusively for transactions that can be proven to have been made by the person through the official ticket sales website or, in the case of physical purchases, by the buyer of the Ticket/Voucher at the ticket office.
4.8. Violation of any of the Access Rules or Terms of Use of the Barbecue Area, as well as any unacceptable behavior that may cause damage, disruption, or harm, will give Parque do Caracol the right to expel the User from the premises.
5. Ticket/Voucher Restrictions:
5.1. Tickets/Vouchers may be sold subject to certain entry or usage restrictions, such as minimum age requirements. Any such restrictions will be displayed or communicated to the User prior to or at the time of booking. It is the User’s responsibility to review these important details shown during the purchase process. Parque do Caracol will not be held responsible if the User or any guest in their reservation is denied entry due to failure to meet or prove compliance with any such restrictions (e.g., a minimum age requirement).
5.2. Discount Rules as outlined on the website https://parquecaracol.com.br/ must be observed by the User at the time of purchase.
5.3. Half-Price and Free Admission: (a) For purchases made via the Parque do Caracol website or ticketing kiosks: individuals purchasing half-price tickets must proceed to the entrance turnstile, where documentation proving eligibility for the benefit will be validated; (b) For purchases made at the ticket office: individuals purchasing half-price or free admission tickets must present documentation proving their eligibility for the benefit at the time of purchase.
6. Event Schedules and Entry and/or Park Access:
6.1. If events or services are announced by Parque do Caracol or its Partners, please note that their start/end times are subject to change.
6.2. By attending an Event, the User agrees to be photographed, filmed, and/or recorded in connection with the Event and/or for safety and security purposes, including recordings made by law enforcement. Additionally, the User agrees that any resulting photographs, videos, and audio and/or audiovisual recordings may be used in any and all media, for any purpose, at any time, and worldwide by Parque do Caracol and its Partners.
7. Event/Service/Ticket Cancellations and Changes by Parque do Caracol:
7.1. If an Event or Service is canceled, rescheduled, or substantially changed, we will make all reasonable efforts to communicate this information. However, we cannot guarantee that the User will be informed of such cancellation, rescheduling, or change, as it may occur at any time, including by decision of a public authority, or due to unforeseen circumstances and/or force majeure.
7.2. If an Event for which the User has purchased Tickets or Vouchers is fully canceled and not rescheduled, the order will be canceled and the User will receive a refund for the amount paid for the Ticket or Package.
7.3. Rescheduling: If an Event or Service for which the User has purchased a Ticket is rescheduled for any reason—including adverse weather conditions, safety concerns, or force majeure—at the discretion of Parque do Caracol (as stated in Clauses 9.5 and 9.5.1), the Tickets/Vouchers will remain valid for the new date.
7.3.1. If the date change is initiated by Parque do Caracol, our Customer Service (SAC) will contact the User with the new proposed date and ask for confirmation. The User must confirm their agreement within the timeframe provided.
7.3.2. If SAC does not provide a specific deadline for the User to confirm or decline the new date, the User may notify us up to 48 (forty-eight) hours before 12:00 a.m. on the new scheduled visit date to request a cancellation or rescheduling.
7.3.3. If the User notifies us within the specified timeframe that they are not interested or unable to attend the new scheduled date, their order may be canceled and they will receive a full refund of the ticket purchase price.
7.4. Failure by the User to notify us within the applicable deadline that they are unable to attend the rescheduled visit, Event, or Service will be considered confirmation of their Ticket or Voucher order for the new date. In such cases, the User will not be entitled to a refund.
7.5. To request a refund in accordance with Clause 7.3, the User must follow the instructions provided in the event/service change notification or submit a written request to Parque do Caracol's Customer Service (SAC) at: [email protected]
7.6. Refunds will be issued using the same payment method employed for the original purchase.
8. Limitation of Liability:
8.1. To the fullest extent permitted by law, Parque do Caracol and its Partners shall not be liable for any loss, injury, or damage to any person (including the User) or property, under the following circumstances:
(a) Where there is no breach of contract or legal duty of care owed by us or the Event or Service Partner
(b) Where such loss or damage is not a direct result of any violation of applicable laws, this Purchase Policy, the Barbecue Area Terms of Use, or any other relevant and applicable provisions; o
(c) To the extent that any increase in loss or damage results from the User’s own negligence, recklessness, lack of skill, or breach of applicable terms, conditions, laws, or regulations
9. 9. Ticket Flexibility, Cancellation, and Rescheduling Policy for the Consumer:
9.1. Tickets purchased are valid for use on the date selected at the time of purchase. However, to provide greater flexibility for the User, if they are unable to attend on the scheduled date, the Ticket may still be used within 7 (seven) calendar days after the originally scheduled date, provided it has not yet been used.
9.1.1. As stated above, although the Ticket is purchased for a specific date, if the User cannot attend on that day and does not use the Ticket, they may use it within 7 (seven) calendar days from the originally scheduled date.
9.1.2. Despite the flexibility provided in Clauses 9.1 and 9.1.1, it is important to note that each Ticket is valid for a single use only. Once used, it cannot be reused or rescheduled.
9.2. In accordance with Article 49 of the Brazilian Consumer Protection Code, the User may request a cancellation within 7 (seven) calendar days from the date of purchase, provided the purchase was made outside the physical premises of Parque do Caracol. In this case, the full amount paid for the Ticket will be refunded using the original method of payment, subject to the conditions outlined below.
9.3. If a Ticket/Package is canceled on the day before the scheduled visit (considering the day before as the period between 12:00 a.m. and 11:59 p.m. of the day prior to the visit), a 20% (twenty percent) cancellation fee will be applied to the amount paid.
9.3.1. This condition applies to Tickets/Packages purchased through the Parque do Caracol website or on-site at the park.
9.3.2. The 7 (seven) calendar day flexibility period for ticket use, as described in Clauses 9.1 and 9.1.1, does not apply for cancellation or rescheduling purposes.
9.4. After 12:00 a.m. (midnight) on the scheduled visit date, or during the flexibility period mentioned in Clauses 9.1 and 9.1.1, cancellations and rescheduling requests will not be accepted.
9.4.1. This condition applies to Tickets/Packages purchased through the Parque do Caracol website or on-site at the park.
9.5. The visit will proceed under the weather conditions present at the time, except in cases where Parque do Caracol, for safety or force majeure reasons, decides to reschedule or cancel the visit, as outlined in Clause 7 of this Purchase Policy and its subclauses.
9.5.1. In such cases, the User will be notified in advance and may choose to either reschedule for a new date or receive a refund, as outlined in Clause 7 of this Purchase Policy and its subclauses.
9.6. Refunds will not be issued for cancellation requests submitted (i) after 12:00 a.m. (midnight) on the scheduled visit date; or (ii) during the flexibility period described in Clauses 9.1 and 9.1.1.
9.7. For purchases made through online channels, cancellation requests must be submitted by the customer via the website https://parquecaracol.com.br/ or through our customer service channels. For purchases made on-site at the Park, cancellations must be requested directly at the Ticket Office or through our customer service channels.
9.7.1. Only the User who completed the purchase is authorized to request the cancellation.
9.8. Once the cancellation confirmation email has been received, the amount paid will be refunded, in accordance with Clauses 9.3 and 9.6, using the same payment method used in the original transaction, according to the deadlines and conditions below:
9.8.1. If the purchase was made in cash, the User will be refunded immediately at the time of the cancellation request at the Ticket Office, provided that the conditions set out in Clause 9.2.3 are met.
9.8.2. If the purchase was made with a credit card, Parque do Caracol will notify the credit card company of the refund within 5 (five) business days.
9.8.3. The actual credit to the cardholder’s account will depend on the issuing bank's processing time and billing cycle. The refund may appear within up to three billing statements, a timeframe that is beyond Parque do Caracol’s control, as it depends on the internal procedures of each credit card issuer. We recommend that the User consult their credit card issuer directly.
9.8.4. If the purchase was made using a debit card at the Ticket Office, Parque do Caracol will notify the financial institution of the refund within 5 (five) business days. In this case, we recommend that the User consult the financial institution directly.
9.8.5. For payments made via PIX, the refund process will begin within 24 hours of the cancellation confirmation. The refund will be completed within a maximum of 72 (seventy-two) hours from the date the User provides the necessary bank account details. The refund must be made to the same account used for the original payment.
9.8.6. Parque do Caracol is not responsible for any delays in the refund process described in Clause 9.8.5 if the User fails to provide the correct bank account information required to complete the refund.
9.9. The User may request to reschedule their Ticket at least 24 hours before 12:00 a.m. (midnight) on the scheduled date of the visit, Event, or Service. The request must be submitted directly to Customer Service (SAC) at [email protected] — or to the responsible Partner, in case of purchases made through third parties — requesting rescheduling to a new available date.
9.9.1. Rescheduling will not be permitted:
(i) after 12:00 a.m. (midnight) on the day prior to the scheduled visit, Event, or Service at Parque do Caracol;
(ii) during the 7-day flexibility period described in Clauses 9.1 and 9.1.1; and
(iii) after the visit, Event, or Service has taken place.
9.9.2. Only the User who made the purchase may request the rescheduling of the order.
9.9.3. Rescheduling may be requested for a date within up to 6 (six) months from the date the rescheduling request is approved by SAC. The new date is subject to ticket availability and current pricing at the time of rescheduling.
9.10. Failure to use the Ticket within the 7-day flexibility period (as provided in Clauses 9.1 and 9.1.1), without prior contact from the User to request rescheduling or cancellation in accordance with the terms outlined herein, will be considered a "no-show." In such cases, no refund or future use of the Ticket will be permitted.
9.11. In the case of a Package purchase, cancellation/rescheduling of one item within the Package will result in the cancellation/rescheduling of the other item(s) in the Package. In other words, if one service within the Package is canceled or rescheduled, the remaining service(s) will also be canceled or rescheduled accordingly.
